View Full Version : anyone ever get hit by an 18-wheeler?
aylmer599 10-04-2007, 07:39 AM well i have, last night on highway 40 in montreal. i was following traffic in the left lane, the two cars in front of me moved to the center lane because of a stopped maintenance truck in the left lane (the guy was picking up tumbleweeds :roll: ) i couldn't move into the center lane right away so i started braking and wham! got nailed by what i thought was a car. it actually was an 18-wheeler who got cutoff himself (he was in the center lane and swerved right behind me because of car cutting him off ) he slammed on the brakes but he got me anyways. it think i'm the luckiest guy ever, because i didn't even go down! when the guy came out of his truck he said: omg i thought you were dead i thought you were going under the truck. he said he was so happy to see me pulling away from him (they have a huge blind spot right in front). anyways the cop got there , filled out the report, told me i was lucky, and to drive it home (2 hours away). it was kind of funny, everyone there (the cop, the truck driver and the maintenance guy) were all in motorcycle accidents when they were younger. we all shared stories with each other and i was on my way home. here's the damage: http://i167.photobucket.com/albums/u135/93conover/0010.jpg

My insurance company is sending someone over to my place to give an estimate on repair, using the shop rate of the bike shop i chose, and then they write me a check! i hope my rates don't go up too much. :hump

Second...Your insurance company???
I think the TT drivers ins. co. should be stepping up to the plate. He rear ended you. Unless the cop can somehow assign blame to the cage that cut off the tractor. Either way there is no way that you or your ins co should be liable for the damage.
Holy monkey! Unbelievable! I'm SO glad to hear that you're alright. Forget A lottery ticket, buy 10.
rndthought 10-04-2007, 12:57 PM No Fault. BTW In Florida, we don't have it anymore. As of Oct. 1st (I think) the bill expired.
Man, thinking about this I'm gonna be extra paranoid when slowing for traffic. Glad got them new mirrors :thumbsup

Dont know how it is up there.. But here, It doesnt matter what happened, If you hit someone from behind.Its your fault ,Period.. I should think the truck driver should have at least some Liability. Unless as rnd said there is a No Fault Law..

aylmer599 10-04-2007, 08:35 PM the way it works up here, my insurance company pays, but i don't have to pay the deductible and my rates aren't supposed to go up but sometimes they do anyways. i wasn't at fault by any means, and there was a police report so the insurance companies know the whole story( the truck driver was good about it and didn't make up any excuses or try to blame it on me, he was mostly glad he didn't kill me.

No Fault just means each persons company pays for their client then sorts it out on the back side (usually as % because rarely is anyone 100% culpable/blameless). Supposedly it gets money faster into the hands of the ones that need it?
I'm even starting to check my mirrors in the car more..."....is he slowing..." :?
